The Organisation  
The MHC is an independent statutory body established in April 2002 under the provisions of the Mental Health Acts 2001-2018 (“the 2001 Act”). The principal functions of the MHC, as specified in the 2001 Act, are to promote, encourage and foster the establishment and maintenance of high standards and good practices in the delivery of mental health services and to take all reasonable steps to protect the interests of persons detained in approved centres. The MHC is also empowered to undertake such activities, as it deems appropriate to foster and promote these standards and practices.  

The Assisted Decision Making (Capacity) Act 2015 (“the 2015 Act”) provides for the establishment of the Decision Support Service (“the DSS”) within the MHC to support decision-making by and for adults with capacity difficulties and to regulate individuals who are providing support to people with capacity difficulties. The 2015 Act reforms Ireland’s capacity legislation which has been in place since the 19th century. It establishes a modern statutory framework to support decision-making by adults who have difficulty in making decisions without help.  
Please note that all reference to the Mental Health Commission include the Decision Support Service.  
  
The Role  
The Deputy Inspector is a newly established senior post in the MHC. It will be central to the delivery of the strategic objectives of the MHC and the annual business plan. The MHC expects to appoint two deputy inspectors in accordance with its expanding role and regulatory remit as set out in the Mental Health Bill 2024. The post holders will work in the Inspectorate division—part of the MHC regulatory team. 

The post holders will report to the Inspector of Mental Health Services and will be a member of the Regulatory Management Team. They will be directly responsible for delivering and managing the inspectorate’s business plans under the direction of the Inspector. They will work closely with the Head of Regulation and the Head of Standards—senior managers in the Standards & Quality Assurance division.  

This collaborative approach will be necessary to achieve the strategic objectives of the MHC and to progress the implementation programme of the expanded remit of the organisation. 

The role will focus on establishing an integrated approach to the inspectorate function. The post holders will collaborate with each other and others within the regulatory team to implement this approach efficiently. 

The Deputy Inspectors will play a key role in enhancing the functions of the Inspectorate. They will focus on organisational scheduling and the strategic planning of inspectorate activities, ensuring smooth operations and seamless coordination of inspections. They will play a central role in developing inspection resources, internal capacity, as well as policies and procedures to support the operations of the MHC, in accordance with current and future regulatory frameworks. 

The successful appointees will play a crucial role in ensuring inspection quality and efficiency. They will adopt and implement organisational and operational changes to optimise resources and improve effectiveness. They will drive progress by refining existing systems and shaping the development of new ones. They will oversee performance management, provide support to and manage a team of assistant inspectors and the wider team, and apply best practice approaches to inspections, drawing from evidence based methodologies. 

They will have internal quality assurance role and develop quality control systems and monitor adherence to internal policy and practice across the regulatory team. To do so they will operate at a high level of seniority, with the ability to collaborate effectively, cover for each other when needed, and contribute to the broader leadership of the regulatory team. They will maintain a detailed understanding of the regulatory legal framework and functions. They will participate in formal regulatory activities in accordance with MHC’s official scheme of delegation of powers. 

The post holders will work collaboratively with subject matter experts to design and implement effective systems for identifying, assessing, and mitigating regulatory risks, ensuring a proactive and evidence-based approach to regulation. They will identify the strategic and operational planning requirements associated with the MHC’s expanded regulatory remit and develop relevant plans that align with broader organizational objectives. 

Essential Requirements 
The candidate must possess, by the closing date, the following: 

  • Master's degree (NFQ Level 9 on the Irish National Framework of Qualifications) in Law, Public Administration, Social Policy, Social Science, Health, Mental Health, or Social Care. 
  • Minimum five years' senior experience in a similar role leading, managing, overseeing, and delivering a programme of inspections and regulatory activities for health, mental health, or social care services. 
  • Experience in developing and implementing inspection and regulatory programmes in the health, mental health, or social care sectors. 
  • Detailed knowledge of regulatory processes and the legislative framework under which the MHC operates, including a comprehensive understanding of the provisions of the Mental Health Act 2001, the Mental Health Bill 2024, the 2006 Regulations, and the suite of rules and codes of practice developed by the Mental Health Commission. 
  • Experience in project management and the ability to coordinate and oversee multiple projects simultaneously. 
  • Experience in applying risk management frameworks to complex information. 
  • Experience in leading, managing, and motivating a team of highly qualified and professional staff.
